 I - OBJECT, SCOPE AND DEFINITIONS


 1) These general conditions govern the sale, including registration, ordering and access to the "Eureka" products offered by Alberto Sousa, Lda, VAT number 501 690 123, registered at the Vizela Register of Companies under the same number, registered office at Rua da Boca, SN, parish of São João das Caldas, municipality of Vizela, on the website www.eurekashoes.com and apply to all sale and purchase contracts for "Eureka" products entered into between Alberto Sousa, Lda and any user who places orders through the above website.

2) For the purpose of these general conditions, the following definitions apply:
 
a) - "Eureka" - The products marketed by Alberto Sousa, Lda, the holder of all copyright and related rights, as well as other rights that might be subject to protection as provided for in the Industrial Property Code, over the web page/site with the above address, and supplier of the goods available for ordering on the same site;

b) - "User" - Any private individual, who is not a trader, who places an order through the web page/site www.eurekashoes.com;

3) These general conditions do not remove the User's rights and guarantees contained in the current legislation for contracts of this nature.

      

      

II – ACCEPTANCE



 1) Entering into sale and purchase contracts for Eureka products implies knowledge and acceptance of the General Conditions by the User.

2)  By accepting the General Conditions, the User confirms that they have read the General Conditions, have the necessary legal capacity to accept them and to enter into the sale and purchase contract for Eureka products. 

    
      

III – REGISTRATION



1)  To place an order the User must have previously registered on the website www.eurekashoes.com by filling in the fields in the form provided.


2)  After registering as a client, the User can access their personal online account, by logging in and entering the personal and non-transferable password they chose when registering.


3)  Once the User has accessed their personal online account, they are subject to these general conditions, and to the legal and regulatory provisions which govern their operation and use.

    

        

IV - EUREKA PRODUCTS



 1) The site www.eurekashoes.com is intended for users of Eureka products who wish to purchase Eureka products from their home or workplace, on a 24/7 basis.

2)  Information on the essential characteristics of Eureka products may be consulted on www.eurekashoes.com. 

3)  Alberto Sousa, Lda reserves the right, at any time, to amend the information, the offer of Eureka products, the prices, promotions and commercial conditions displayed on the site www.eurekashoes.com. 
  
    

V - ORDERS



 1) Once logged in to their personal online account at www.eurekashoes.com, the User can purchase Eureka products by following the steps below:

 

a) Use the search icons or menus to select the desired product(s);

 

b) Add the selected product(s) to the User's shopping cart;

 

c) Register the User's personal details, with an option to include them in the Alberto Sousa, Lda database according to the terms provided for in the General Conditions;


d) Indicate "Delivery Location", "Invoicing Location" and "Method of Payment";


e) Enter the User's taxpayer number;


2)  Alberto Sousa, Lda will make all purchasing details available through the site www.eurekashoes.com, allowing for the identification and correction of any errors, and will request acceptance of the purchase terms and conditions, as well as the General Conditions;


3)  The User will be notified of the status of their order by an "Order Confirmation" email, and a second "Order Shipment" message, after payment is validated.


4)  Finally, the User's order will be delivered by the logistics operator at the "Delivery Location" mentioned on placement of the order and with the respective itemised invoice.


5)  Placing online orders for products included in the "Shopping Cart" reflects the acceptance by the user of their purchase for the prices and under the terms described on the site www.eurekashoes.com. The user can only, in any case, place orders through the www.eurekashoes.com site at the prices and under the terms and conditions announced therein.


6)   In the event that Alberto Sousa, Lda does not accept the User's order for any reason, a right that Alberto Sousa, Lda expressly reserves, the User will be notified to this effect.


7)  The fulfilment of any orders placed on the above site is subject to the availability of Alberto Sousa Lda, which will seek to ensure a sufficient stock of all products for sale on the site. Alberto Sousa Lda, however, reserves the right to not accept any orders or to cancel orders already confirmed for products out of stock, and in such cases, Alberto Sousa Lda shall notify the User of this fact and reimburse the amount received within 30 days. 


8)  Alberto Sousa, Lda will not accept orders in any of the following situations:


a)  The "Delivery Location" is outside Mainland Portugal, Portugal islands (Madeira and the Azores), Austria, Belgium, Bulgaria, Croatia, Denmark, Scotland (UK), Slovakia, Slovenia, Spain (excluding islands), Estonia, Finland, France, Germany, Greece, Hungary, England (UK), Ireland (Republic), Northern Ireland (UK), Italy, Latvia, Lithuania, Luxembourg, Wales (UK), Netherlands, Poland, Czech Republic, Romania and Sweden;


b)  The total amount of the order is above €1,500.00 (one thousand five hundred euros);


c)  The products purchased are intended for resale;


d)  The product is not available from Alberto Sousa, Lda warehouses (in which case the User will not be able to add the product to the "Shopping Cart");


e)  Payment is not made by one of the payment options available on the site www.eurekashoes.com;


f)  Payment is not confirmed.

  


VI – PRICES


1)  All prices for Eureka products quoted on the site www.eurekashoes.com, are inclusive of Value Added Tax (VAT) at the rate of 23% or the rate which, from time to time, may result from existing legal provisions. The total VAT payable by the consumer will be indicated in the invoice to be sent to the User.

2)  The prices of Eureka products, as well as their characteristics, are subject to change without any prior notice by Alberto Sousa, Lda. However, such changes will be disclosed on the site www.eurekashoes.com in order to keep users informed, so it is understood that the User is aware of them before placing an order.

3)   If an error occurs in the price of the products ordered, both Alberto Sousa, Lda.and the User may cancel the order at any time, up to the shipping of the products.

4)  Prices are always subject to final validation, and according to the invoice issued for the purchase.
 

  

VII - METHODS OF PAYMENT AND SECURITY



1)  In order to promote the privacy and security of documents and information conveyed via the Internet, Users can make payment for their purchases through the payment managing entity, Caixa Geral de Depósitos, whose registered office is at Av. João XXI, 63 1000-300 Lisboa, Portugal.


2)  For this purpose, Caixa Geral de Depósitos will make payment available by credit transfer or credit card (Visa, Master Card), Credit Card conditions being available at the time of consultation/payment. 

    

VIII - DELIVERY COSTS



 1) The costs of standard deliveries are only supported by Alberto Sousa Lda, in Mainland Portugal, for orders above 50€, according to promotional conditions at the time.

* The delivery times given has reference to the date of the order shipping and are presented on weekdays (Saturdays, Sundays and holidays do not count on delivery time). In cases of majeure force, Alberto Sousa, Lda can not be held responsible for any delivery delay.


IX – DELIVERY


1)  Alberto Sousa Lda will ship the product(s) ordered by the User from Monday to Friday, except on holidays and during the logistics company's working hours, to the address indicated by the User when confirming the order.

2)  Alberto Sousa Lda undertakes to fulfil the order from the 2nd day following payment up to a maximum of 30 days from the date of payment validation.


3)  The response ability of Alberto Sousa, Lda within the above deadlines, however, is conditional on stock availability. 

4)  Alberto Sousa Lda shall notify the User if any ordered product(s) are unavailable, and will reimburse any amounts paid for such product(s) within 30 days from the date of notice of such unavailability 

5)  In the above situation, if the consumer chooses to exercise their right of free termination, the return costs shall comply with the following table:

6)  The order is deemed to be shipped from the moment Alberto Sousa, Lda delivers it at the carrier's premises, and the carrier will be responsible for its delivery to the User under the terms below:

a) The products will be shipped and delivered to the Consumer by the carrier who will be liable for any delay in delivering the order.
b) In the absence of anyone to receive and sign the acknowledgement of receipt at the "Delivery Location", the logistics operator will not make the delivery.
c) In this case, the Consumer will be contacted by the carrier to reschedule the delivery, and the Consumer will be charged a fee of €4.

7)  A delivery is deemed to have been made or a product delivered upon signature of the receipt of delivery at the agreed address.

 

        

X – RIGHT TO CANCEL (FREE TERMINATION) AND RETURNS



Cancel your order before shipping:

 

1) The customer can cancel the order as long as its status allows, before shipping. 

2) In this case, the Customer must contact our Customer Care asking for the order cancel by the email customer@eurekashoes.com. Only after this, we can inform if it is possible to cancel your order.  If the order was not shipped, the customer will be notified by email.




Defective Products Returns


The customer is entitled to return products delivered to you in the event that they are defective or otherwise not in conformity with your order when you received them. This does not affect your statutory rights. You can do so within 30 days after you notice the defect.  We will fully examine the return product and will notify of your right to a refund (if any). In general, the refund will be processed. Refunds will be issued based on the original form of payment. If you choose to return the defective articles to our main warehouse, please use the following address:

Please note that you must always attach the shipping costs receipt for reimbursement. If the returned package does not contain this information, reimbursement of shipping costs will not be considered.




Before proceeding with the return, check:

  • The item cannot have been used, washed or damaged (we suggest that the shoes be tested on a carpeted surface before use/wear);
  • The item must be in its original packaging;
  • Returns will only be accepted within 30 days after the delivery date;
  • Separate returns of the same order will not be accepted;
  • The above conditions must be observed so that Eureka can assess the reimbursement of the article.


Upon receipt of the order, the customer has a 30-day period to return or exchange their article(s). Exchange/return costs are borne by Eureka (valid in Continental Portugal for packages up to 2 kg and in the case it's a first exchange. In subsequent returns, shipping costs (€4), shall be borne by the customer (except on the grounds of duly identified quality issues).

How can I exchange an item I purchased at the online shop?

In physical stores, we only allow exchanges for items of equal or higher value, in stores in Portugal (excluding Outlets) and in the Netherlands, in accordance with the above-mentioned conditions and duly accompanied by the respective invoice. If you want to make an exchange for another different article, you should always select the Return option.


Can I return my order at any physical Eureka Shoes store?

Returns regarding items bought at our online store are not accepted at our network of physical stores.

  1. Valid only for the 1st (first) exchange of an item(s), for each new order;
  2. Offer valid only for the 1st (first) exchange of an item(s), for each new order. Shipping fees regarding the product(s) to be returned, shall be borne, initially, by the customer). However, the value may be reimbursed later. Therefore, you must attach documentary proof of the shipping fees regarding the return, for refund purposes, up to a maximum value of €20. Without this information, the reimbursement of the fees regarding the Return cannot be carried out.
  3. In case of Return of article (s) Outlet or 2nd (second) exchange of article (s) the costs of Shipping costs are borne by the customer. The cost of the service is equal to € 4, in Continental Portugal, this cost of service being subject to change, without prior notice;
  4. Scheduled Collection Service - UPS Carrier (Shipping fees to be borne by the customer). The cost of the Collection Service is approximately €9.90 for each item, within the European Union, and this service cost may be subject to change without prior notice.




Exchanges online:

In the case of a Return, you can only choose a different colour or size of the same Model, with regard to the original order.

  2. In the area "My Account" on the menu, choose "Exchanges and Returns";
  3. Select the desired order;
  4. Once selected, choose the "Exchange" option;
  5. Select the "Collection method":
    • Portugal - Mainland: At an Address;
    • Madeira / Azores and Spain: Customer ships to the Eureka Shoes Warehouse;
    • Netherlands: Customer ships to the Eureka Shoes Warehouse B.V.;
    • Other EU markets (AU, DE, FR, IT, BE, LU): At an address or a Pick-up Point;
  6. Select the "Reshipping method";
  7. End with "Exchange".


How can I return an item I purchased at the online shop?

For customers who are registered on the www.eurekashoes.com website.


 Returns online:

The returns must always be initiated through the Online Store, on the www.eurekashoes.com website.

Please follow the instructions that appear below:

  1. Sign in to your Account;
  2. In the area "My Account" on the menu, choose "Exchanges and Returns";
  3. Select the desired order;
  4. Once selected, choose the "Return" option;
  5. Select a "Collection method":
    • In Portugal - Mainland: At an Address;
      • Request a Collection for the original address, the address where you received your package. All pick-ups (collection) are scheduled through a contact between the carrier (FEMA/GLS) and the customer. Later, you will receive an SMS Collection confirmation!
    •  In Madeira / Azores and Spain: Customer ships to the Warehouse.
      • You should send the product(s) to the Eureka Shoes - Logistics A/C Online Store, at the following address: Alberto Sousa, Lda - Rua da Boca s/n, 4815-640 Vizela.
    • In the Netherlands: Customer ships to the Warehouse;
      • You should send the product(s) to Eureka Shoes, at the following address: Eureka Shoes B.V - Binnenhof 16, 1181 ZG - Amstelveen.
    • Other EU markets (AU, DE, FR, IT, BE, LU): At an Address or a Pick-up Point.
      • If you want to return your order through a Collection at an Address, you should pack the article(s) in the original box(es) and stick on the "BACK" freight bill sticker that came with the initial order.
      • If you want to return your order through a Pick-up Point, you should pack the article(s) in the original box(es) and stick on the "BACK" freight bill sticker that came with the initial order. Then, you must head to your nearest Pick-up Point and deliver the Return package. Check the available Pick-up Points list - UPS access point locator: https://www.ups.com/dropoff.
  6. End with "Return".


UNREGISTERED CUSTOMER

If you placed your order as an unregistered customer, you can initiate the Return procedure through the link sent in the Confirmation Email and, consequently, proceed with the remaining process.
Please note: If you have multiple items to return in the same order, you must Return or Exchange them at the same time. After the request to return an article of an order, our website will not allow you to go back to perform an Exchange or a Refund.


When and how will I receive the refund?

Once the returned order is received, Eureka will examine and confirm its condition and, once approved, you will be refunded in the amount corresponding to the article returned, in the same way in which you made your purchase.

If the returned items are damaged or worn, Eureka reserves the right not to accept the Exchange/Return and to refuse their refund. Any fees and taxes which have been paid either by shipping or returning your order, will not be refunded.

After receiving the return package, and if all the requirements of our return policy are confirmed, you will receive an email informing you that the refund will be processed. The time required to make a refund depends on the payment method used and can go up to 15 days:
  • Credit Card: The time frame for the refund amount to be credited to your account depends on the policy of the bank that issued the card;
  • PayPal: the refund will be credited to your PayPal account and will be immediately visible. The time frame for the refund amount to be credited to the credit card associated to your PayPal account depends on the policy of the bank that issued the card;
  • ATM References: the refund will be credited to your bank account after the reception and verification of your returned item(s). When using this payment method, in the event of a return and to proceed with the refund, you should inform us of your IBAN, which has to be from the same country of the billing order. Without this information we will not be able to transfer the amount of the refund.




XI – COLOURS


Alberto Sousa, Lda will make every effort to ensure that the colours of the products displayed on the site www.eurekashoes.com are as accurate and true as possible. However, because computer screens vary, we cannot guarantee that your screen will show the accurate colours.
  
           

XII – CLAIMS



 Bearing in mind the continuous improvement of its services, Alberto Sousa, Lda will endeavour to deal with and settle within 5 (five) working days any claims submitted by the Consumer by email customer@eurekashoes.com. 


  

XIII - GUARANTEES AND AFTER-SALES SERVICES


 Eureka products come with a guarantee of conformity as provided for in the legislation applicable to the sale of consumer goods. 
     
 

XIV - WAIVER AND LIMITATION OF LIABILITY

 

 

 1) Alberto Sousa, Lda will not guarantee that the www.eurekashoes.com service will always be available, and will not accept responsibility for damages arising directly or indirectly from the use or inability to use the website, for whatever reason, namely in the case of unavailable of access, technical issues or errors in the telematic data transfer networks, outside interference or presence of computer viruses, nor will it accept responsibility for any technical issues that may occur in computer equipment used while connecting to the internet through the site.


2)  Similarly, Alberto Sousa, Lda will not accept responsibility for damages arising directly or indirectly from force majeure events, understood as any event beyond the control of Alberto Sousa, Lda preventing it, in full or in part, definitely or temporarily, from complying with its obligations, including strikes, electrical power cuts, failures in telecommunications services or other services, fires, flooding, inability to obtain products, materials or services, breakdowns, delays by suppliers or carriers and changes to the law or to administrative regulations.


3)  Alberto Sousa, Lda will not be liable for any misuse of the User's personal and non-transferable access data to the site by third parties.


  

             

XV - MODIFY GENERAL CONDITIONS

 

Alberto Sousa, Lda reserves the right to amend these General Conditions at any time, upon notice which is deemed to have been given by publication of the amended General Conditions on the www.eurekashoes.com site. 
 


     

XVI - PERSONAL DATA


Please consult our Privacy Policy were we support the data protection principles set out in Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data, applicable from 25 May 2018.   

XVII – DURATION

  
 1) These general conditions shall apply as long as the supply of goods through the site www.eurekashoes.com lasts.

2)  The above provision shall be without prejudice to any revisions or amendments of these conditions.

3)  The declaration of invalidity of one or more general conditions does not preclude the application of the others or the invalidity of the transaction concluded. 

  
      

XVIII - PROOF AND FILING

 

 1) Any computer records kept in the computer systems of Alberto Sousa, Lda are deemed to be proof that a contract has been entered into between the parties, as well as of its terms and conditions.


2)  Any documents supporting orders and related invoices will be filed on a reliable and durable medium and can be consulted whenever the Consumer so wishes. 


 

XIX - APPLICABLE LAW AND COMPETENT COURT

 

 1) These General Conditions shall be governed by Portuguese Law.


2)  Any issues or disputes arising from these General Conditions or the contracts to which they apply or are part of, notably with regard to their validity, efficacy, construance, completeness, application or fulfilment, shall be submitted to the exclusive jurisdiction of the Guimarães District Court, with the express waiver of any other.


3)  However, should they so decide, Consumers may alternatively resort to out-of-court claim mechanisms, in particular the Alternative Settlement of Consumer Disputes and the Online Settlement of Consumer Disputes.
